Rental Terms and Conditions

Contract/Agreement

This agreement between PURE Krabi Limited Partnership and you, the renter, was made on the "the rental date" and is valid until the "end date" or any day after if rental has been extended beyond the original booking dates.

Duration of Hire

The term of the hire shall commence and cease at the time and dates described within the confirmed booking information. The hirer remains liable for additional rental charges if the vehicle is not returned by the specified time and date. Late returns are charged at 25% of the daily rental price, per (partial) hour.

Payment by Hirer

The hirer shall pay to the rental company the full amounts indicated in the agreement for the hire of the vehicle, including security deposits, and any such additional charges as indicated on booking. Full payment needs to be completed latest on delivery of the vehicle.

Full refunds are available up to 7 days before the start of the rental. For rentals of 2 weeks or longer this is 14 days. The cancellation fee also applies to changes we can not fulfill within this time or shortening your reservation. The down payment will be non refundable and actual rental days are charged additionally.

Refunds are processed through the same channel as used for payment.

Insurance and damage

For our cars: In the event of an accident or damage occurring, where the hirer is at fault, responsible, or where there is no 3rd party present that can be held liable, the hirer will be liable to pay the set deductible of a maximum of 5,000 THB to bring the vehicle back in its original state. The deductible applies also to lost keys, other items belonging to the vehicle and damage to the interior. The rental company determines the amount on the basis of damage and repair time, taking into account loss of income.

For our motorcycles: In the event of an accident or damage occurring to motorcycle and/or accessories, where there is no 3rd party present that can be held liable, the hirer will be liable to pay for all damages to bring the motorcycle and/or accessories back into the state it was in at the start of the rental. This includes damages which are over the valued amount of the security deposit.

A refundable security deposit of 5,000 THB is applicable to all our motorcycle rentals. This can paid in THB or an equivalent in another currency, and needs to be handed over on delivery.

Hirers Obligations

Especially, but not only, for longer rentals, the hirer shall ensure that the vehicles radiator water and battery water level are maintained at proper levels, the oil level is checked and maintained at the proper level, and that the tires are maintained at the proper pressure. The hirer shall ensure that all reasonable care is taken in handling and parking the vehicle and that the vehicle is left securely locked when not in use.

The cost of petrol, but not oil, used during the term of the hire is the responsibility of the hirer. The vehicle is delivered fully fueled and has to be returned fully fueled. Refueling should take place within 15 kilometers of the drop off location.

If not FULLY refueled on return PURE Krabi will charge, for our cars, 300 THB per (partial) divider bar on the fuel meter. For motorcycles this is 150 THB.

Smoking in our rental cars is NOT permitted and will be penalized with a cleaning fee of 900 THB.

The hirer is encouraged to take pictures of any existing damage to the vehicle before hire commences.

The hirer shall not use wet clothing or swim wear on the car seats. Any signs of salt water staining will be charged for. Excessive sand in the interior of the car will be charged for. Additional cleaning costs are charged at 900 THB.

Indemnity Exclusions

The indemnities referred to above shall not apply where damage, injury or loss arises when –

(a) The driver of the vehicle is under the influence of alcohol or any drug that affects his ability to drive the vehicle

(b) The vehicle is in an unsafe or un-roadworthy condition that arose during the course of the hire and that caused or contributed to the damage or loss, and that the hirer or driver was aware of or ought to be aware of the unsafe or un-roadworthy condition of the vehicle.

(c) The vehicle is operated in any race, speed test, rally or contest.

(d) The hirer is not a body corporate and the vehicle is driven by any person not-named as being authorized to drive the vehicle as listed in the hire agreement.

(e) The vehicle is driven by any person who at the time when he drives the vehicle is disqualified from holding, or who has never held, a license appropriate for that vehicle.

Mechanical Repairs

If the vehicle is damaged or requires repair or salvage, whether because of an accident or breakdown, the hirer shall advise the rental company of the full circumstances by telephone as soon as practicable. The hirer shall not arrange or undertake any repairs or salvage without the authority of the the rental company except to the extent that the repairs or salvage are necessary to prevent further damage to the vehicle or other property.

The hirer shall ensure that no person shall interfere with the distance recorder or speedometer, or, except in an emergency, any part of the engine, transmission, braking, or suspension systems of the vehicle.

Use of Vehicle

The hirer shall not –

(a) Sublet or hire the vehicle to any other person

(b) Operate the vehicle, or permit it to be operated in circumstances that constitute an offence by the driver, which relates to driving or attempting to drive with excess breath or blood alcohol or under the influence of alcohol or drugs.

(c) Operate the vehicle or permit it to be operated to tow any other vehicle

(d) Operate the vehicle or permit it to be operated for the transport of more than the number of passengers, or more weight of goods specified in the certificate of loading for the vehicle

(e) Drive or permit the vehicle to be driven by any person who is not a holder of a current driver's license appropriate for the Vehicle

(f) Allow anyone to be seated in the vehicle with wet/dirty/sandy clothes or any other factors that could cause damage.

In the event of an accident

You are obliged to inform the police and the rental company immediately and provide a police report. Please phone us immediately if you are unfortunate enough to have an accident of any kind.

Return of Vehicle

The hirer shall, at or before the expiry of the term of the hire, in person, return the vehicle to a PURE Krabi representative, not to the hotel or agent, or obtain the rental company's consent to the continuation of the hire. All vehicles are hired out in a clean condition, therefore it is the responsibility of the person hiring the vehicle to return it in good condition and fully refueled.

When returned with wet or salt water stained interior, excessive sand, sun cream on the interior or any other form of excessive soiling, the hirer will be obligated to pay an additional 900 Baht for the cleaning of the car.

Immediate Vehicle Return Where Damage or Default

The rental company shall have the right to terminate the hiring and take immediate possession of the vehicle if the hirer fails to comply with any of the terms of the hire agreement, or if the vehicle is damaged. In case of an accident where the vehicle is repossessed, the remaining rental fee is NOT refunded. The termination of the hiring shall be without prejudice to the rights of the rental company and the rights of the hirer under the hire agreement.

Drivers License

All drivers must hold a current, non-probationary license. The license may either be Thai, or from a renter's country of residence with an English translation, clear symbols or an additional international drivers permit. Licenses must be carried at all times when driving. Having a proper license is the full responsibility of the renter. Having an international driving permit is strongly advised and the renter's responsibility, but rental will be possible and covered only on the basis of your country's issued license.

Documents upload

The rental company requires a copy of passport and driving license for each vehicle rental. The renter is required to upload these. All documents can be marked against misuse, as long as ALL details are still visible. The code lines on the bottom of the passport do not need to be visible.

On delivery of the vehicle THE SAME documents need to be shown for verification.

Disputes not covered by this agreement

If any dispute arises, for which there is no solution covered by this agreement, the dispute will be dealt with according to Thai local laws.
